Post-implementation Reviews

Where a proposal proceeds through a final Australian Government decision without a compliant Regulation Impact Statement, the resulting regulation must be the subject of a post-implementation review. The review should be completed within two years of the regulation being implemented, and is required regardless of whether or not an exemption from the RIS requirements for exceptional circumstances was granted by the Prime Minister. In addition, for regulations assessed by OBPR as having a substantial or widespread impact on the Australian economy, a PIR must be completed within five years following the implementation of the regulation. A post-implementation review examines the problem that the regulation was intended to address, the objectives of government action, the impacts of the regulation and whether the Government’s objectives could be achieved in a more efficient and effective way.
